Arrested innocence???????????

Police are outside an apartment known only that the man (a thief) they are after is inside. Inside there is a Lawyer, a Fireman, a Banker, a lifeguard and doctor playing poker at the table...when the police bust in and arrest the fireman without questioning. How are they sure they've got the right man?
